The following rules establish the privacy and data security policy processed by www.onino.eu, in this special case of personal data according to the European Regulation 679/2016 (GDPR). This policy explains how we, www.onino.eu, as the operator, use any type of personal information you may provide during the use of the website or when placing an order.
Personal information means any type of information that can identify you personally (for example, your name, address, or email). The information provided when registering is used to allow you access to certain parts of the www.onino.eu site, as well as to issue fiscal or transport documents following the purchase of products or services.

1. How to create and delete a user account?
- To place an order on our website www.onino.eu, you have the option to create a user account by filling out the electronic registration form, available via the "Create Account" button. This is not a mandatory condition.
- Orders can also be placed by phone or through a shortcut method (which does not require the creation of a user account). To create an account, it is necessary to complete all fields marked as mandatory on the electronic registration form.
- The fields required for your registration may be changed at any time by www.onino.eu (or other third-party operators). Registration of individuals without legal capacity or with restricted legal capacity is not permitted, and if a breach of this clause is discovered, www.onino.eu reserves the right to suspend/cancel the user account.
- By creating a user account, the client guarantees that all provided data is real and correct, otherwise, they may bear the consequences of these errors (delayed order, incorrectly transmitted, etc).
- You are responsible for all activities conducted through your account, and you are obligated to maintain the security and confidentiality of the username and password associated with your Account, except where www.onino.eu grants permission in writing, you may have only one Account.
- Each Client is entitled to delete their account by contacting www.onino.eu at hello@onino.eu. Any request for deactivation will be taken over by www.onino.eu and completed within a maximum of 30 days from its registration.
- Deactivation will not affect the Client's obligations arising from the use of our site at that time, intended to survive such deactivation. www.onino.eu may deactivate a user account or suspend access to the Site if a Client violates the Terms and Conditions of Use or for other inappropriate conduct, without prior notice.
- In the event of deactivation of the user account, www.onino.eu is entitled to immediately suspend access of that person to the Site. In such cases, www.onino.eu will not be liable for any damages and loss of profits suffered by the Registered User or third parties as a result of the suspension of access to a customer's account.
2. How to Place an Order?
- Placing an order is done by selecting the desired products from www.onino.eu and adding them to your cart. The order must be confirmed by the Customer after verifying the accuracy of the cart contents, using the “Checkout” button.
- The price displayed at the time of finalizing the order includes VAT.
- The shipping cost is 25 RON for orders under 399 RON. For orders exceeding 399 RON, shipping is free.
- By placing the order, the Customer agrees that a representative from www.onino.eu may contact them via any available means agreed upon by the parties (email/phone) for personal confirmation of the Order.
- The initial email received is just a confirmation of receipt of your order request.
- Your contract for purchasing these products is not fully concluded until we send an email announcing that the products have been shipped. www.onino.eu may refuse an order following prior notification to the customer verbally or in writing, without any obligations between the parties and without any party being able to claim damages, in the following situations:
- Failure/invalidation of the online transaction (non-payment of the invoice sent by email),
- Incomplete or incorrect customer details,
- Customer activity that may cause damage to www.onino.eu or our partners;
- Consecutive failed deliveries;
- Other objective reasons including, but not limited to, cases where the customer does not guarantee that the payment method is valid and that it is not obtained through a fraudulent method or there are suspicions regarding the payment method. Please ensure that the email address and telephone number you have provided are correct and accessible. If you cannot be contacted by phone upon the arrival of the orders at your address, www.onino.eu reserves the right to cancel the delivery, with the consequence of keeping the ordered products and undertaking legal actions to recover any damages suffered.
3. How are orders paid for and delivered?
- All prices displayed on the www.onino.eu website include VAT.
- Any order placed through the www.onino.eu website is contractually binding and implies acceptance of the terms and conditions of use.
- Products are delivered via courier. The shipping cost is 25 RON for orders under 399 RON. For orders exceeding 399 RON, shipping is free.
- Delivery will be made within 2-3 working days from the confirmation of the order, excluding Sundays and public holidays. In exceptional cases, where the ordered product is not in stock at the time of placing the order, you will be notified by www.onino.eu operators about the possibility of delivery at a later date, although this cannot be guaranteed.
- It is possible that a product with depleted stock may not be restocked, and its price or features may change in subsequent purchases. Products that are currently out of stock cannot be delivered.
- The fiscal invoice will be sent electronically to the provided email address. The customer may at any time later request the invoice in printed format, signed and stamped, if their business activity requires it (legal entity) or simply prefers to keep the invoice in printed format.
- www.onino.eu accepts payment for orders via debit or credit cards. In the case of canceled orders that have already been shipped to the client, a refund of the order value will only be made after the return of the already dispatched parcel.

- In the case of pricing errors not related to the www.onino.eu website (technical errors, platform errors, delayed price updates, etc.), the company assumes no responsibility for these situations. Any clarification will be discussed with the client by phone afterwards.
4. What are our responsibilities regarding delivered products?
- www.onino.eu guarantees the replacement and/or acceptance of returns for products deemed non-conforming to the website description or customer expectations within 14 calendar days from their delivery.
- www.onino.eu is not responsible for delayed product deliveries if it is due to the courier service used.
- Product stocks displayed on the website may differ from actual stocks in certain situations, therefore product and/or order confirmation will be conducted exclusively by phone. An order confirmation received via email does not guarantee the reservation of products or stock and has no fiscal value.
- The images displayed on the site are illustrative; products may differ in terms of color, appearance, or functionality, and in this case, www.onino.eu guarantees the return of products within 14 calendar days of delivery. The features and availability of the products presented on this site may change without prior notice.
- The maximum value of www.onino.eu's obligations to any customer in case of non-delivery or improper delivery of purchased products is the value of the sums collected by our company from that customer.
- If prices or other details about products have been incorrectly displayed, including due to incorrect data entry into the database, www.onino.eu reserves the right to cancel the delivery of the respective product and to notify the customer as soon as possible about the error that occurred. Orders that are not confirmed by phone will be canceled.
5. How can a product be returned? Information about the right of withdrawal
The customer has the right to withdraw from this contract within 14 calendar days, without needing to provide a reason. The withdrawal period expires 14 calendar days after the date of purchase.
According to Article 9 of Emergency Ordinance No. 34/2014 from June 4, 2014, regarding consumer rights in contracts made with professionals, “the consumer has a period of 14 days to withdraw from a distance contract or a contract concluded outside of commercial premises, without having to justify the decision to withdraw and without incurring costs other than those provided in Art. 13 para. (3) and Art. 14.”
According to Article 13 of Emergency Ordinance No. 34/2014:
- “The professional (BABYSAFE INTERNATIONAL SRL) will refund all sums received as payment from the consumer, including, where applicable, delivery costs, without undue delay and in any event not later than 14 days from the day on which the professional is informed of the consumer’s decision to withdraw from the contract in accordance with Art. 11.
- The professional will refund the mentioned amounts using the same means of payment as the consumer used for the initial transaction, unless the consumer has expressly agreed to a different method, on the condition that the consumer does not incur any fees as a result of the refund.”
Consumer obligations in case of withdrawal, according to Article 14 of Emergency Ordinance No. 34/2014:
- “Unless the professional has offered to collect the goods themselves, the consumer must return or hand them over to the professional or a person authorized by the professional to receive the goods, without undue delay and in any event not later than 14 days from the day on which they communicate their decision to withdraw from the contract in accordance with Art. 11. The deadline is met if the products are sent back by the consumer before the 14-day period has expired, if the product has the original packaging and if the product shows no signs of wear.
- The consumer only bears the direct cost of returning the products unless the professional agrees to bear those costs or if the professional has failed to inform the consumer that these costs will be borne by the consumer. […]
- The consumer is only responsible for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. Diminished value of the goods should not deter the consumer from exercising their right of withdrawal. Regardless of the situation, the consumer is not responsible for the diminished value of the goods if the professional has failed to inform them about the right of withdrawal in accordance with Art. 6 para. (1) lit. h).
- The professional must be able to prove any diminished value of the goods that results differently from what is necessary to establish the nature, characteristics, and functioning of the goods.”

Returned products will be sent or personally brought to the address of the BABYSAFE INTERNATIONAL SRL warehouse, which will be communicated by the sales agent when they are informed of the return. Products will NOT be returned through Romanian Post and will not be shipped to any address other than the one specified by the sales agent.
If the ordered product does not match the presentation on the www.onino.eu website or has manufacturing defects, you may request its replacement or a refund within 15 calendar days from the moment you received it.
Information on exercising the right of withdrawal
You have the right to withdraw from this contract, without stating the reasons, within 14 calendar days.
The withdrawal period expires 14 calendar days from the day on which you or a third party, other than the carrier and indicated by you, physically receive the goods, or in the case of multiple goods ordered in a single order and delivered separately, the day on which you or a third party, other than the carrier and indicated by you, physically receive the last item.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement sent via email, mail, telephone, fax, SMS, or verbally to BABYSAFE INTERNATIONAL SRL using any of the contact details provided for this purpose.
If the products are sealed, the seal must not be broken – the product must be returned sealed, for health protection or hygiene reasons.
The condition of the purchased products must be the same as when they were bought/received, including keeping the packaging intact.
For health or hygiene reasons, such items cannot be returned once unsealed or used once, e.g., pacifiers, teething chains, teething toys – according to Art 16. lit. e / Ordinance 34/2014.
CONSEQUENCES OF WITHDRAWAL
If you withdraw, we will reimburse all payments we have received from you, including delivery costs (established according to the details above), except for the additional costs resulting from your choice of a delivery method other than the least expensive type of standard delivery offered by us, without undue delay and in any event not later than 14 calendar days from the day on which we are informed of your decision to withdraw from this contract.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any case, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
Send the products back or hand them directly to us at the warehouse address from which they were shipped, an address you will receive in writing by email immediately after confirming receipt of the withdrawal request, without undue delay and in any event not later than 14 calendar days from the day on which you communicate your withdrawal from this contract. The deadline is met if the products are sent back before the expiration of the 14-day period.
You will have to bear the direct cost of returning the products.
You are only liable for any diminished value of the products resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the products.

7. What is the Commercial Warranty and Conformity Guarantee of the products?
Commercial Warranty
The commercial warranty is according to the warranty certificate issued by the manufacturer, depending on the product category, and represents the period during which the consumer benefits from free repairs provided by the seller/manufacturer.
Conformity Guarantee
All products are covered, by law, with a conformity guarantee, which represents the legal period of 2 years in which the product is brought into conformity for the consumer at no charge. Conformity refers to the product features communicated to the consumer through the advertising made by the seller/manufacturer.
During the conformity guarantee period, the manufacturer repairs, replaces, or refunds the product value in accordance with Emergency Ordinance 140/2021. The time period set for the repair resolution cannot exceed 15 calendar days from the date the buyer notified the seller of the product's non-conformity.
According to Government Ordinance 21/1992, the seller is obligated to provide the consumer with:
- a warranty certificate (only for long-term use products),
- an instruction manual/user guide.
8. Final provisions and Limitation of Liability
- www.onino.eu makes every effort to ensure the information on the site is accurate and up-to-date, but does not guarantee the authenticity or completeness of the content and does not commit to updating information unless otherwise specified.
- www.onino.eu strives to ensure the optimal operation of the site, but is not obligated and does not guarantee that these services will meet the client's requirements or that they will be continuous, timely, and secure.
- By accepting these Terms and Conditions, the client declares that the use of the services provided will be entirely at their own risk and responsibility, and agrees that www.onino.eu will not be liable for any damages that may be suffered by the registered user during the use of the services or the site, except where such damages are intentionally caused by www.onino.eu or due to its gross negligence. www.onino.eu will not be liable to you for any direct, indirect, special, or consequential losses or damages arising from contract, law (including negligence), or otherwise from your use or inability to use the site.
If www.onino.eu is found liable to you, our total liability is limited to the purchase price of the products you paid for in your order. We will not be liable for any loss of profits or damages suffered by the client or any third party, arising from the termination, modification, or limitation of services or deactivation of the user account, due to the client's breach of these Terms and Conditions or applicable law, or due to information or decisions issued by competent authorities.
www.onino.eu will not be responsible for the content and information of any third parties, including, but not limited to, advertisements, banners, or other promotional materials, placed on the site. Although all measures have been taken to ensure that the information presented on this site is accurate and correct, www.onino.eu cannot be held responsible for inaccuracies that may occur in the completion by the Client of the forms on the site to finalize the order.
Clients are responsible for evaluating the accuracy, completeness, and usefulness of the information provided within the forms available on this site. If any of the above clauses are found to be null or invalid, regardless of the cause, this clause will not affect the validity of the other clauses. By making a purchase and placing an order, the client accepts without objection the conditions and terms of use, their value being the same as a validly concluded contract.

This Privacy Policy applies exclusively to information that is provided or collected through all services provided by www.onino.eu via the website.
